Family mediation is where divorcing, separating couples meet with professionally trained and experienced Mediators in a neutral, confidential environment, to discuss and agree solutions regarding property, finance and child care arrangements.
Mediation can improve communication, reduce bitterness and benefit your children. The decisions made are yours and not imposed by a judge or third party. Mediation can be quicker, cheaper and less stressful than court proceedings.
The aim of mediation is to:
- Help families affected by divorce or separation
- Provide a safe environment to discuss the future
- Find agreement and avoid conflict
Mediators are:
- Professionally qualified
- Neutral - they do not take sides and will not pre-judge
- Skilled at dealing with disagreements
Mediation is not:
- Counselling or therapy - it is about dealing with the practical side of separation
- Legal advice - that must come from your solicitor
- Reconciliation - it will not try to reconcile you with your partner
Mediation can be on any issue arising from the break-up of your relationship. The main issues are usually about children, property and finance.
Your first meeting with a Mediator is called an assessment meeting and lasts about an hour. You can attend on your own or with your ex-partner. If it is agreed that mediation is right for you, a mediation appointment is made for you and your ex-partner. During each session the Mediator encourages you both to talk about what you think is best for you and your situation and what options you want to consider for the future.
If you are eligible for public funding then mediation is free. Otherwise you will be asked to pay a fee before each session. Our current charges will be explained to you when you first contact the Family Mediation Service.
